Yes. If Family isn't right for you, ask within 30 days of any Family charge, including a renewal, and we'll refund it in full, no questions asked. You keep the welcome kit. Gifts work a little differently: an unused gift code can be refunded within 30 days of purchase, in full if the kit hasn't shipped, or less $25 if it has.

Questions families ask

Does she ever pay for anything?

No. She uses Brightwend free, and she's never asked to pay or shown a price. Brightwend Family is paid for by family, or given as a gift. If she uses Brightwend on her own and wants the book, she can give Family to herself from the app. Then she's the one paying, and it's her own choice.

Does she have to go?

Never. Every task is a suggestion, not an instruction. Only go if you're up to it today. "Not today" is always a fine answer.

What's in the book?

Her Year of Good Days is a hardcover with every day she shared that year. Each day has up to 2 photos, her note, the place on a map, who picked it, and the family's notes printed beside it. Only days she chose to share are printed. It's included with Family, and printed and mailed at no extra cost.

Where do the kit and the book go?

To you, the person paying (or the person who bought the gift), at the address you give when you pay. We'll mail the welcome kit and, at the end of the year, the book to you, so you can wrap it and hand it over yourself. We never ask her where she lives.

What if my address changes?

Change it any time in settings. The new address applies to anything that hasn't shipped yet. 30 days before her book prints, we'll send you a preview of every page, where you can hide a day or fix a caption, and ask "Is this still the right address?" The address locks when the book goes to print. If a kit or book comes back to us, we'll reship it once for free.

What if she takes a break?

She can pause for 1 week, 2 weeks, a month, or until she turns it back on. Family only sees "taking a little break", never why. A Family year is 365 days in a row from when Family starts, and pausing doesn't stop it. But if her breaks add up to more than 30 days in the year, we add those days to the end of the plan free, up to 90 days, and her book moves with them. If she's shared fewer than 20 days by the end of the year, we'll ask you whether to print now or keep adding and print later.

What happens if we stop Family?

If the trial isn't continued, Family is cancelled, or a gift year ends, she keeps using Brightwend free. She chooses the one person who stays in her circle. Everyone else is paused, not deleted, and comes back if Family starts again. Her days stay hers: everything she's shared stays in her app, and her book pages are kept.

Can she remove me?

Yes. It's her circle, and only she decides who's in it. If she removes the person who pays, the plan keeps running for her. We'll let you know, and you can still cancel under the 30-day money-back guarantee.

Is there a money-back guarantee?

Yes. If Family isn't right for you, ask within 30 days of any Family charge, including a renewal, and we'll refund it in full, no questions asked. You keep the welcome kit. In short

  • Only do a task if you feel up to it. If you're unwell, tired, or your health makes it unwise, skip it. Use your own judgment every time.
  • Every task is optional. You know your body and your day best.
  • Brightwend isn't an emergency or monitoring service. If someone is hurt or in danger, call 911.
  • We never share anyone's live location. Not with family, other users or anybody else.
  • Meeting other people is off unless you turn it on, and only you can turn it on.
  • Brightwend will never ask you for money, gift cards or bank details.

Don't take a suggestion if you're not up to it. A Brightwend task is a suggestion, never an instruction, and never advice that something is safe for you. If you don't feel well, if your health, mobility, eyesight, hearing or medicines make it unwise, or if it just doesn't feel right today, don't do it. Choose "Not today" or the stay-at-home idea instead. You know your body, your health and your day better than we do, so use your own judgment every time.

A word about scams. Nobody from Brightwend will ever ask you for money, gift cards, bank or card details, your Social Security number, or the code we text you. If anyone does, even someone claiming to be us, stop and email [email protected].

Before you head out

  • Check the weather. On very hot days, in storms, or when there's a weather warning, pick the stay-at-home task instead. Summer heat in the South is hard on everyone.
  • Call ahead if hours, paths, parking or restrooms matter to you. The phone number is on every place card.
  • Tell someone where you're going, and take your phone, some water, and anything you usually need.
  • Turn around whenever you like. If something doesn't feel right on the way or when you get there, going home is the right call. It still counts as getting out.
  • If you're not sure an activity suits your health, ask your doctor first.

What Brightwend isn't

Brightwend suggests things to do. It isn't a medical, care, emergency, monitoring or transport service, and nobody at Brightwend is checking whether you went out or came home. Family members shouldn't rely on it to know someone is safe. If anyone is hurt, unwell or in danger, call 911.

Location

  • We don't collect your live location, and the app never asks for it.
  • We never ask for your home address. We only ask which areas you'd like to get out to. The one exception is your choice: if you give Brightwend Family to yourself, we ask where to mail your kit and book when you pay.
  • If your family pays for Brightwend Family, they give their own mailing address for the welcome kit and the book. We never ask for yours.
  • Nothing in the app shows where you are right now, or where you tend to be on a certain day.

Meeting other people

Brightwend can let you know when others have enjoyed the same place. For example, "11 other people did this today." That never shows who they were.

If you'd like to go further and connect with people who've been to the same places, there's a setting for it. It is off to start with. When it's on:

  • Nothing is shown in real time. Connections are after the fact and delayed.
  • Both people have to say yes. Nobody can search for or browse other members.
  • There are no private messages at first, only comments on a shared task. Messaging opens up only after you both add each other.
  • Members must be verified, or vouched for by a family member in their circle, before they can use this setting. Verification confirms basic details. It isn't a background check, so please use the same care you would with anyone you've just met.
  • You can report or block anyone, any time, from their name.

Your family can't change this setting for you. We think that decision belongs to you.

Family circles

Family members can see only what you choose to share, and they can send encouragement. They can't change your settings, see your location, or read notes you kept to yourself.

Only you add people to your circle, by texting them a link from your own phone. Each link works once and lasts 14 days.

With the Family plan, a family member can send you somewhere: they pick a place near you, and it becomes your suggestion on a day it's open. It's still a suggestion, not an instruction. Only go if you're up to it today, and "Not today" is always fine. They can also plan an outing with you and offer a ride. That ride is between you and them. Brightwend doesn't provide or arrange transport.

You can pause Brightwend for 1 week, 2 weeks, a month, or until you turn it back on. Your family only sees that you're "taking a little break", never why.

People who read the app's content

Every task is read by a person before it's published. People on our team also review reports. We keep that work going as the app grows, because keeping people safe is a lasting part of running Brightwend.

Report something

Use "Report" on any comment or person in the app, or email [email protected]. If someone is in danger, call 911 first. If you're worried an older adult is being mistreated or exploited, you can call Adult Protective Services in your county.

Who we share it with

  • Your family circle: only what you choose to share.
  • Service providers who help run Brightwend, such as hosting, text and WhatsApp delivery, payments, website analytics, and the AI tools that help us word your daily task. They can use your information only to provide their service to us, under contract.
  • The law: if we're legally required to, or to protect someone from serious harm.
  • A new owner: if Brightwend or Agori Labs is ever sold or merged, this policy would continue to apply to your information.

We don't sell your personal information. We don't share it for advertising, and we don't let AI providers train their models on it.

Text messages. We don't sell, rent or share your mobile number, or your agreement to receive texts, with anyone for their own marketing. See the Text message terms.

How long we keep it

We keep your information while your account is open. If you delete your account, we delete your information within 30 days. The only exceptions are records we're required to keep by law, such as billing records.

Your choices and rights

  • Change your answers any time in the app.
  • Download a copy of your scrapbook and information.
  • Delete your account in the app, or email [email protected].
  • Stop the daily message, or change the time it arrives.

We give these rights to everyone, whatever state you live in. We'll reply to requests within 30 days.

Security

We encrypt your information in transit and at rest, limit which staff can see it, and sign you in with one-time codes rather than passwords. No system is perfectly secure. If a breach ever affects you, we'll tell you promptly.

Children

Brightwend is for adults. We don't knowingly collect information from anyone under 18.

Changes

If we change this policy in a way that matters, we'll tell you in the app before the change takes effect.

1. Ideas are drafted, then reviewed by a person

We use AI to help draft task ideas, like "Find the rose you'd plant if you had room for one more." Each idea goes into a review queue. A person on our team approves, edits or turns down each one. Nothing is published until someone has read it.

2. Places come from our list, never from AI

AI can sound sure about a market that closed years ago. So AI doesn't choose places. Every place in Brightwend comes from a list we keep, with the address, phone number and the details the venue publishes about itself.

3. Matching to you

Each morning we pick one approved task that fits the areas, interests and ways of getting around you told us about, plus how long you said you have. The wording can change slightly to suit you, but only within what our reviewers approved.

4. "Why this one"

Every task comes with a short line explaining the choice, like Gardening · paved paths · Wilmington · morning. If a task doesn't make sense for you, tap "Not today" and tell us why. That's the most useful thing you can do to improve tomorrow's task.

What tasks are meant to be

  • Around half an hour or less, unless you say you have more time
  • Free or close to it
  • Something you can do alone
  • Something worth telling someone about afterwards

What our reviewers turn down

Before a task can be published, the person reviewing it checks that it doesn't ask you to:

  • Go into water, climb, use a ladder, or do anything strenuous
  • Drive, or travel far, unless you've told us that suits you
  • Go into anyone's home, or meet a stranger alone
  • Spend more than a few dollars, or buy anything from anyone
  • Give out personal or financial information
  • Stay outdoors for long in the middle of the day

If you see a task that seems wrong, unsafe or unkind, tap "Report" or email [email protected]. A person reads every report.

Please check before you go. We pass on what each place publishes about itself. We don't visit or inspect places, and we can't promise the details are current. Hours, paths, parking, ramps, restrooms and closures change. If anything matters to you, call the place before you set out. The phone number is on every place card.

Where our place details come from

Every place card shows what the place, or the city, county or state that runs it, says about itself. We always name the source, for example: "The garden describes its paths as packed gravel." We never describe a place as accessible in our own words.

What every place card includes

  • The name and full street address
  • A link that opens the place in Google Maps
  • The place's phone number, where it has one
  • What the place publishes about access, parking and facilities, with the source named
  • An illustration of the place

Your judgment comes first

Every task is optional. You know your body, your day and the weather better than we do. If something doesn't feel right when you get there, it's always fine to turn around. That still counts as getting out.

Brightwend is built for people of every age and ability, so accessibility is part of the product itself. This page covers how the app and website are built. For the places we suggest, see Place information.

What's built in

  • Three text sizes, chosen in Help, and the whole app follows them. The app also respects your phone's own text-size setting.
  • Hearing mode. Everything spoken is written out, no task depends on sound, and the daily message arrives as a text rather than a call.
  • Large buttons with plenty of space between them.
  • Strong contrast between text and background, in light and dark mode.
  • Screen reader support for VoiceOver and TalkBack, with every button labeled.
  • A back button on every screen, and one decision per screen.
  • Reduced motion. If your phone is set to reduce motion, the app does too.

Our standard

We're working to meet the Web Content Accessibility Guidelines (WCAG) 2.2 at level AA, and we test with older adults, not just with automated tools. Some parts may still fall short. If you find one, we want to hear about it.

Terms of service

In short

  • Brightwend suggests things to do. Every one is optional. Only take one on if you feel up to it and are well enough to do it safely. Use your own judgment. You take part at your own risk.
  • Brightwend isn't a medical, emergency, care or transport service. In an emergency, call 911.
  • Place details come from the places themselves. Check before you go.
  • The person who uses Brightwend agrees to these terms themselves, even when a family member set it up or paid.
  • The Family plan renews every year until you cancel, with a 30-day money-back guarantee on every charge. Gifts never renew.
  • What you write and record stays yours.
  • If we ever have a disagreement we can't sort out by email, it goes to individual arbitration or small claims court, not a class action. You can opt out of arbitration within 30 days.

Please read sections 3, 4 and 18 closely. Section 3 is about taking part at your own risk, section 4 says what Brightwend is not, and section 18 is about how disagreements are settled, including arbitration and giving up class actions.

1. This agreement

These terms are an agreement between you and Agori Labs Inc. ("we," "us," "our"), which operates Brightwend: the website, the web app, the mobile apps, and our text, WhatsApp and email messages. You agree to them when you create an account, buy a plan or a gift, or use Brightwend in any other way. Our Privacy policy, Safety page and Text message terms are part of this agreement.

2. Who can use Brightwend

  • You must be 18 or older and able to agree to a contract.
  • Brightwend is offered in the United States. The places and services it suggests are in the states listed on our home page.

Setting it up for someone else

  • Many people set Brightwend up for a parent or relative. If you do, you must have their permission, and the account belongs to them, not to you.
  • The person who will use Brightwend is asked to read and accept these terms themselves the first time they sign in. Until they do, they won't get daily tasks.
  • The person who pays (for the Family plan or a gift) agrees to these terms for the purchase: the price, renewal, refunds, mailing and the gift rules.
  • You can't agree to text messages on someone else's behalf. The person whose phone it is must agree, as explained in the Text message terms.

3. Activities are your choice, and at your own risk

Brightwend suggests everyday activities: walking somewhere, visiting a public place, meeting people, making or noticing something. Everyday activities carry everyday risks, including trips and falls, heat, cold, sun, storms, insects and animals, traffic and travel, uneven ground, crowds, and the actions of other people.

  • Don't take a suggestion if you're not up to it. Only do an activity if you feel well enough and are physically able to do it safely. If you're unwell, tired or recovering, or if your health, mobility, balance, eyesight, hearing or medicines make an activity unwise, skip it. A suggestion from Brightwend is never advice or a recommendation that an activity is safe or suitable for you. Use your own judgment every time.
  • Every activity is optional. "Not today" is always a fine answer, and there's always a stay-at-home option.
  • You decide. We don't know your health, your fitness, the medicines you take, the weather where you are, or how you feel today. You're the best judge of whether an activity is safe and sensible for you, and whether to stop or turn around at any point.
  • Check the conditions. Look at the weather before you go, and skip outdoor tasks in extreme heat, storms or other warnings. Tell someone where you're going, take your phone, and take water.
  • Ask your doctor if you're unsure whether an activity is right for you.

To the extent the law allows, by choosing to do an activity you accept the risks that come with it, and you agree that we're not responsible for injury, illness, loss or damage that happens while you do it, unless it was caused by our own gross negligence or willful misconduct.

4. What Brightwend is not

Brightwend is not a medical, health, therapy, care, emergency, monitoring, transport or safety service. It doesn't replace advice from your doctor, and it doesn't watch over anyone. Nobody at Brightwend is checking whether you went out, came home, or are well. If you or someone else is hurt, unwell or in danger, call 911.

Family members can't use Brightwend to supervise or keep track of someone, and should never rely on it to know that a person is safe.

5. Places, and things outside our control

Details about places, including hours, access, paths, parking, restrooms and facilities, come from what those places or the organizations that run them publish. We name the source, but we don't visit or inspect places, and we can't promise the details are accurate, complete or current. Please confirm anything that matters to you before you go. The phone number is on every place card.

We don't own, run or control the places we suggest, or any event, business, transport or other service you use to get there or while you're there. They're responsible for their own premises and services. Links to maps and other websites are there to help you. We don't control them.

6. Doing things with other people

The Family plan lets family members suggest an outing and offer a ride. Any ride is arranged between you and your family member. Brightwend doesn't provide, arrange, check or insure transport, and isn't responsible for it.

Family circles

  • Only the person who uses Brightwend adds people to their circle, by texting an invite link from their own phone. Each link works once and lasts 14 days.
  • The free version includes one family member in the circle. The Family plan includes everyone they invite.
  • When the Family plan ends (a trial that isn't continued, a cancelled plan, or a gift year that's over), the person who uses Brightwend chooses the one family member who stays in their circle. Everyone else is paused, not deleted, and comes back if the Family plan starts again. Everything they've shared stays in their app, and their book pages are kept.
  • If they remove the payer. If the person who uses Brightwend removes the person who pays from their circle, the Family plan keeps running for them. We'll tell the payer, who can still cancel under the 30-day money-back guarantee in section 9.

Meeting other members

Connecting with other members is off unless you turn it on. If you do, use your own judgment. Meet in public places, tell someone where you're going, and never send money, gift cards or personal financial details to anyone you met through Brightwend. Verifying a member confirms basic details about them. It isn't a background check, and we can't vouch for anyone's character or behavior. You're responsible for your own dealings with other members. See Safety.

7. Your account

You sign in with a one-time code sent by text or WhatsApp, or with Google. Keep your phone and your codes to yourself. Nobody from Brightwend will ever ask you for a code. You're responsible for what happens in your account, so tell us straight away at [email protected] if you think someone else is using it.

8. Messages we send

We send one daily message, sign-in codes, and a small number of account messages, such as receipts, renewal reminders and changes to these terms. We send texts only to people who have agreed to receive them, and you can stop them any time by replying STOP. The details are in the Text message terms. By using Brightwend you agree that we can give you notices electronically, by email, text or in the app.

9. The Family plan

  • Price. The Family plan costs $179 a year, plus any applicable tax. It's paid by the family member who sets it up. From time to time we may offer a promotional price for the first year, such as a holiday price. The price you'll pay, and the price it renews at, are shown before you confirm.
  • Free trial. New Family plans start with a 14-day free trial. The first-year price shown when your trial starts, such as a holiday price, is locked in at that moment. If you don't cancel before the trial ends, your payment method is charged for the first year. We'll remind you before the trial ends.
  • Automatic renewal. The Family plan renews automatically every year, at the regular price at that time, and is charged to your payment method on file until you cancel. After a promotional first year, it renews at the regular price. We'll email you a reminder at least 15 days before each renewal, with the date and the amount.
  • Cancelling. You can cancel any time in the app, or by emailing [email protected]. Cancelling stops future renewals. Your plan stays active until the end of the year you've paid for.
  • 30-day money-back guarantee. If you ask within 30 days of any Family charge, including a renewal, we'll cancel the plan and refund that charge in full to the original payment method. You keep the welcome kit if it has already shipped. After 30 days, payments aren't refunded, except where the law requires it or as set out in section 12.
  • Price changes. If we change the price, we'll tell you at least 30 days before it applies to you, so you can cancel first if you'd like.
  • Welcome kit and book. The Family plan includes one welcome kit (valued at $25), mailed to the payer within one business day of the first paid year starting. It's yours to keep. It also includes the Year of Good Days book, printed and mailed at no extra cost. See section 11.

10. Gifts

  • A Brightwend gift is a one-time payment of $179, or the promotional price shown at checkout, for one year of the Family plan for one person, starting on the day the code is redeemed.
  • Gifts don't renew automatically, and we won't charge the buyer again. After the gift year, the person can choose to subscribe at the regular price.
  • The price is set when the gift is paid for. It doesn't matter when the code is redeemed.
  • Gift codes don't expire. They can't be exchanged for cash, resold or combined with other offers, except where the law requires otherwise. Each code can be redeemed once.
  • Keep the code safe, like cash. If a code is lost or stolen before it's redeemed, the buyer can ask us to cancel it and issue a new one. We can't replace a code that someone has already redeemed.
  • We may cancel codes that were bought with a stolen card, obtained by fraud, or sold on without our permission.
  • Each gift includes a welcome kit (valued at $25), mailed to the buyer within one business day of purchase. The Year of Good Days book is mailed to the buyer too, as set out in section 11.
  • Refunds. If a code hasn't been redeemed, the buyer can ask for a refund within 30 days of purchase: in full if the welcome kit hasn't shipped yet, or less $25 if it has, in which case the buyer keeps the kit. A redeemed code can't be refunded. We refund the amount actually paid, to the original payment method.

11. The welcome kit and the Year of Good Days book

  • Where they go. We mail the welcome kit and the book to the person who paid for the Family plan, or who bought the gift, at the address they give when paying. We never ask the person who uses Brightwend where they live, unless they buy the Family plan for themselves, in which case they are the payer and give their own address when paying.
  • Changing the address. The payer can change the mailing address any time in settings. A change applies to anything that hasn't shipped yet.
  • Preview, and the address lock. 30 days before the book prints, we send the payer a preview of every page. They can hide a day or fix a caption, and we ask them to confirm the mailing address is still right. The address locks when the book goes to print.
  • Delivery. We mail to addresses in the United States only. Delivery dates are our best estimate, not a promise. If a kit or book is lost or arrives damaged, tell us within 30 days and we'll send a replacement. If a kit or book is returned to us, we'll reship it once for free.
  • What "a year" means. A Family year is 365 days in a row from the day the Family plan starts (for a gift, the day the code is redeemed). Pausing doesn't stop it. If the person who uses Brightwend pauses for more than 30 days in total during the year, we add those paused days to the end of the plan at no charge, up to 90 days, and the book moves with them.
  • A thin year. If fewer than 20 days have been shared by the end of the year, we'll ask the payer whether to print the book now, or keep adding days and print it later.
  • What's in the book. The Year of Good Days book is included with the Family plan. It has every day the person chose to share with their family circle during the year: up to 2 photos, their note, the place on a map, who picked it, and the family's notes beside the day. We only print what they chose to share. Pictures of the book on our website are illustrations, and a real book will look different.

12. Before we open, and if we ever close

  • If you buy a gift before Brightwend opens, the code works from the day we open, and we'll email you when it does.
  • If we stop offering Brightwend, we'll give you at least 30 days' notice where we can. We'll refund the unused part of any paid Family year, and refund any gift code that hasn't been redeemed.

13. Your content

  • Notes, photos and voice notes you add stay yours.
  • You give us permission to store them, process them (for example, to write out voice notes as text), show them to the people you choose to share with, and print notes and photos in their Year of Good Days book. We use them only to provide Brightwend to you and your circle. We don't use them for advertising, and we don't let AI providers train their models on them.
  • If you delete something, that permission ends, except for copies already printed or already shared with your circle.
  • Only add things you have the right to share. Ask before you photograph or record other people, and don't upload anything that's unlawful or that belongs to someone else.
  • We may remove content that breaks these terms or puts someone at risk.
  • If you believe something on Brightwend infringes your copyright, email [email protected] with the details, and we'll look into it promptly.

14. How to behave

Be kind. Don't use Brightwend to harass, threaten, deceive or exploit anyone; to ask for money, gifts or financial details; to sell things; or to contact people who haven't agreed to hear from you. Don't pretend to be someone else. Don't try to break, overload, scrape, copy or reverse-engineer the app, or get into accounts that aren't yours. We may warn you, remove content, or suspend or close accounts that break these rules, especially where someone's safety or money is at risk.

15. Our part

Brightwend, including its tasks, place cards, illustrations, design, name and logo, belongs to Agori Labs Inc. and is protected by law. While you follow these terms, we give you a personal, non-transferable permission to use Brightwend for your own non-commercial use. If you send us ideas or feedback, we're free to use them without owing you anything.

16. App stores

If you download Brightwend from the Apple App Store or Google Play, these terms are between you and us, not the store. The store isn't responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You also agree to follow the store's own terms of use.

17. Disclaimers and limits

We work hard to make Brightwend useful and safe, but it's provided "as is" and "as available." To the extent the law allows, we don't make any promises about it beyond those in these terms, including any implied promises that it's fit for a particular purpose or will always be available, accurate or error-free.

To the extent the law allows:

  • We're not responsible for indirect, incidental, special or consequential losses, or for lost profits or data.
  • We're not responsible for the places, events, businesses or transport we suggest or link to, or for the actions of other members or of anyone you meet or travel with.
  • If we're found responsible for something, our total liability to you for all claims is limited to the greater of what you paid us in the 12 months before the claim, or $100.

Nothing in these terms limits liability that can't be limited by law, including for our gross negligence, fraud or willful misconduct. Some states don't allow some of these limits, so they may not all apply to you.

If you break these terms or the law, or infringe someone else's rights, and that leads to a claim against us, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.

18. If we disagree: informal first, then arbitration

Talk to us first. Most problems are sorted out quickly. Before starting a formal claim, email [email protected] with your name, how to reach you, what went wrong and what you'd like us to do. We'll do the same if we have a claim against you. Both of us will try in good faith to settle it within 60 days.

Arbitration. If we can't settle it, you and we agree that any dispute about Brightwend or these terms will be decided by binding individual arbitration, not in court, except as described below. The arbitration will be run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. It can take place by video or phone, or in the county where you live. For claims under $10,000 that aren't frivolous, we'll pay the filing, administrative and arbitrator fees. The arbitrator can award the same individual relief a court could. The Federal Arbitration Act governs this section.

Exceptions. Either of us can instead bring an individual claim in small claims court, if it qualifies. Either of us can go to court to stop the misuse of our intellectual property.

No class actions. You and we each agree to bring claims only on an individual basis, not as a plaintiff or class member in a class, collective or representative action. If a court decides this paragraph can't be enforced for a particular claim, that claim (and only that claim) will be heard in court, not in arbitration.

You can opt out. You can choose not to be bound by this arbitration section by emailing [email protected] within 30 days of first agreeing to these terms. Tell us your name and the phone number or email on your account, and say that you're opting out of arbitration. Opting out won't affect anything else about your account.

Changes. If we change this section, the change won't apply to a dispute we already know about.

19. Which law applies

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules, and by federal law where it applies. This doesn't take away any protection you have under the consumer protection laws of the state where you live. Any claim that isn't arbitrated, and isn't in small claims court, will be heard in the state or federal courts located in Delaware, unless the law of your state entitles you to bring it where you live.

20. Changes to these terms

We may update these terms as Brightwend changes. If a change matters, we'll tell you by email or in the app at least 30 days before it takes effect, except where a change is needed sooner for safety or legal reasons. If you keep using Brightwend after that, the new terms apply. If you don't agree with them, you can cancel and delete your account before they take effect.

21. Ending

You can stop using Brightwend and delete your account at any time. We may suspend or close an account that breaks these terms, puts someone at risk or is used for fraud. Where it's safe to, we'll tell you why and give you a chance to download your scrapbook. If we close your account without good reason, we'll refund the unused part of any paid year. Sections that by their nature should continue, such as 3, 4, 13 and 17 to 19, still apply after an account is closed.

22. The rest

  • These terms, and the pages they link to, are the whole agreement between you and us about Brightwend.
  • If any part is found unenforceable, the rest stays in effect.
  • If we don't enforce a part straight away, we haven't given up the right to enforce it later.
  • You can't transfer your account or these terms to someone else. We can transfer them to a company that takes over Brightwend, and these terms will continue to apply.
  • We're not responsible for delays or failures caused by things outside our reasonable control, such as hurricanes and other severe weather, power or network outages, or problems with the services we depend on.

What you'll receive

  • Your daily task: one message a day, at the time you choose, if you pick text or WhatsApp for it.
  • Sign-in codes, when you ask for one.
  • Account messages, such as a reminder that a gift is waiting, or a note that something in your family circle needs you. These are rare.

We don't send advertising by text. Message frequency varies, and is usually one or two messages a day.

Who agrees to the texts

Only the person whose phone it is can agree to receive our texts. If a family member sets Brightwend up for you, your first message from us asks you to confirm. We won't send daily tasks to your number until you do.

Agreeing to texts isn't a condition of buying anything. You can use the app, or choose email, instead.

Stopping and help

  • Reply STOP to any text to stop receiving them. We'll send one message confirming you've been removed.
  • Reply HELP for help, or email [email protected].
  • You can also change how and when your daily message arrives in the app.

Costs and carriers

Message and data rates may apply, depending on your mobile plan. Mobile carriers aren't responsible for delayed or undelivered messages.

WhatsApp

If you choose WhatsApp, your messages are delivered through WhatsApp, and WhatsApp's own terms and privacy policy also apply. You can stop WhatsApp messages by replying STOP, or by blocking our number in WhatsApp.

Your number and your privacy

We don't sell, rent or share your mobile number or your agreement to receive texts with anyone for their own marketing. We share your number only with the companies that deliver our messages for us. See our Privacy policy.

A tip from us: the best time to give it is when you're in the same room. Most families set it up over the holiday visit, so the first task arrives the morning after you leave.

Questions

How is this different from a memory book?

Memory books send a question a week and ask your parent to look back. Brightwend sends one small thing to do every day and gets them out making new memories. The printed book at the end maps a year they actually lived, in their own words.

What's in the welcome kit?

A large-print setup card with the gift code, a linen field notebook, a short letter with the first three things to do, and four stamped postcards addressed back to you. It's a $25 value, included with every gift, and it goes in the mail right away.

We bought it at the holiday price. Does the code still work after December 31?

Yes. The price is locked in when you pay. The code is a full year of Brightwend Family whenever it's used, and it never expires.

Will it renew automatically?

No. A gift covers one year and then stops. Near the end we'll ask whether anyone wants to continue, at the regular price. Nobody is charged unless they say yes. If nobody does, they keep using Brightwend free, and choose the one person who stays in their circle.

Where do the kit and the book go?

To you, at the address you give when you pay. We'll mail the welcome kit now and the book at the end of their year, so you can wrap it and hand it over yourself. We never ask them where they live. You can change the address any time in settings until the book goes to print.

What if they don't have a smartphone?

Brightwend also works in the web browser on a tablet or computer. The daily message can arrive as a text, which works on any mobile phone.

They already use the free version. Can I still give it?

Yes. Redeeming the code upgrades their existing account. Nothing they've saved is lost.

Can I give it to more than one parent?

One gift covers one person, and the rest of the family joins their circle for free. For two parents, buy two gifts.

What if it's not for them?

If the code hasn't been used, you can get a refund within 30 days of purchase. If the welcome kit has already shipped, you keep it and we refund everything except $25. If it hasn't shipped yet, we cancel it and refund you in full. Email [email protected].

Brightwend exists because a lot of good days don't happen for want of the first two. Plenty of apps are built to keep you looking at the screen. Brightwend is built to get you out the door, then get out of the way.

The name

Wend is an old English word meaning to go on your way, at your own pace. Bright is how we hope you come home. There's a happy coincidence, too. Eliza Brightwen was a Victorian naturalist who wrote about the everyday wonders she found by paying attention close to home. That's not a bad description of what we're trying to do.
